1. Acceptance of Terms

By accessing or using the Brenda's Beach Resort & Spa token sale platform ("Platform"), purchasing Hubren (HBR) tokens, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Platform or services.

These Terms constitute a legally binding agreement between you and Brenda's Beach Resort & Spa ("we," "us," or "our").

2. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Comply with all applicable laws and regulations in your jurisdiction
• Not be located in a jurisdiction where token sales are prohibited
• Provide accurate and complete information when registering

We reserve the right to refuse service to anyone at our sole discretion.

3. HBR Token Purchase

3.1 Token Nature and Rights

HBR (Hubren) tokens are utility tokens that may provide access to resort services, staking rewards, governance rights (if applicable), and other benefits within the Brenda's Beach Resort & Spa ecosystem. HBR tokens are not:

• Securities, investment contracts, or financial instruments
• Guaranteed to appreciate in value
• Backed by any physical assets or reserves
• Entitled to dividends, profits, or revenue sharing (unless explicitly stated)

Token functionality and benefits are subject to change based on platform development and regulatory requirements.

3.2 Payment Methods

We accept payments in the following cryptocurrencies:

• Ethereum (ETH) - Ethereum network
• USDT (Tether) - Ethereum or Binance Smart Chain networks
• BNB (Binance Coin) - Binance Smart Chain network
• Other supported cryptocurrencies as announced

Important: All transactions are processed on public blockchains and are irreversible once confirmed. You are responsible for:

• Ensuring you send the correct amount to the correct address
• Using the correct blockchain network (e.g., Ethereum vs. BSC)
• Paying sufficient gas fees for transaction confirmation
• Verifying transaction details before submission

3.3 Pricing and Availability

Token prices are determined by:

• Current market conditions and cryptocurrency exchange rates
• Token sale phase and pricing tiers
• Bonus structures and promotional offers

We reserve the right to:

• Modify token prices at any time
• Suspend or terminate the token sale
• Limit purchase amounts per user
• Refuse or cancel purchases at our discretion

Token availability is not guaranteed. The token sale may end early if the maximum supply is reached.

3.4 Refund and Cancellation Policy

Refund requests must be submitted within 7 days of the transaction date and will be reviewed on a case-by-case basis. Refunds, if approved, will be processed in the same cryptocurrency used for the original purchase, minus any applicable network fees.

No refunds will be provided for:

• Change of mind or buyer's remorse
• Token price fluctuations after purchase
• Loss of private keys or wallet access
• User error in transaction details (wrong address, wrong network, etc.)
• Regulatory changes in your jurisdiction
• Platform modifications or service changes

To request a refund, contact us at support@brendasresortandspa.com with your transaction hash and reason for the request.

4. Risks and Disclaimers

4.1 Investment Risks

IMPORTANT: Purchasing HBR tokens involves significant financial risk. Token values may fluctuate and you may lose your entire investment. Cryptocurrency investments are highly speculative and volatile.

4.2 No Guarantees

We do not guarantee:

• Token price appreciation or stability
• Resort completion or opening dates
• Specific returns or profits
• Uninterrupted platform availability
• Error-free operation of smart contracts

4.3 Regulatory Compliance

You are solely responsible for ensuring your purchase and use of HBR tokens complies with all applicable laws, regulations, and tax obligations in your jurisdiction.

5. User Responsibilities

You agree to:

• Maintain the security of your wallet and account credentials
• Not engage in fraudulent, illegal, or harmful activities
• Not attempt to manipulate token prices or exploit the Platform
• Provide accurate information and update it as necessary
• Comply with all applicable laws and regulations
• Not use the Platform for money laundering or other illegal purposes

6. Referral Program

Our referral program allows you to earn rewards for referring new users. By participating, you agree to:

• Not engage in fraudulent referral activities
• Not create multiple accounts to generate false referrals
• Comply with all referral program terms and conditions
• Accept that referral rewards are subject to change or termination

7. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is the property of Brenda's Beach Resort & Spa or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE PLATFORM OR HBR TOKENS.

Our total liability shall not exceed the amount you paid for HBR tokens in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Brenda's Beach Resort & Spa, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

10. Platform Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We are not liable for any loss or inconvenience resulting from such modifications.

11. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any breach of these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Brenda's Beach Resort & Spa is incorporated, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
